Terms and Conditions

1. RETURNS
 
 
In addition to your statutory rights to cancel your Contract set out in clause 3 below, if you are not entirely satisfied with your purchase, you may return it to us within 14 days of the date shown on your dispatch note. Products must be returned to us in accordance with clause 4 (‘How to make a return’) below. We may refuse to provide a refund where Products are not returned in accordance with clause 4. This does not affect your statutory right as a consumer to cancel the Contract, as set out below.
 
Some products are non-returnable for hygiene reasons. This is indicated in the product description.
 
2. RETURNS POLICY ON LINGERIE
 
Please make sure that briefs/thongs/swimwear etc. are tried on over your own underwear. In the interest of hygiene, we may refuse returns where we reasonably consider that this has not been done.
 
3. CANCELLATION OF THE CONTRACT
 
If you are contracting as a consumer, you may cancel your Contract with us at any time within 7 working days, beginning on the day after you receive the Product(s) which are the subject of the Contract.
 
In order to cancel your Contract, you must notify us in writing at sam@evadesigns.co.za within the 7 day Period and then return the Product(s) to us in accordance with clause 4 below.
 
Notification of return of your Products via the online procedure will not constitute notification of cancellation of your order for the purposes of your statutory rights to cancel the Contract.
 
Please note that in order to cancel your Contract, you must return all the Products that were covered by the order. You must take reasonable care of the
 
Products that you wish to cancel and not use or wear them.
 
4. HOW TO MAKE A RETURN
 
If you wish to return a Product, you must notify us of your intention to do so before returning the Product. You can do this by emailing sam@evadesigns.co.za.
 
Once you have notified us that you wish to return a Product, you must return the Product to us in accordance with the procedure set out below. For those customers that don't have a registered account, please enclose a note inside the parcel and follow the process below:
 
Returning the parcel
 
  1. Repack the item in its original packaging.
  2. Over-sticker your address with the Eva Designs address label found at the bottom of your delivery note. Be sure to add your Receipt number under 'Returns
  3. Reference' or enclose a note inside with reasons for return.
  4. *Return the package by using the Post Office counters and obtain a certificate of posting from the Post Office. NB Please do not post the package through the post box without obtaining a certificate of posting
*Keep your Certificate of Postage safe, as you will need this as your proof of return.
 
Products should be returned to us in the condition they were in when delivered to you, together with all accessories and packaging that were supplied with the Product(s).
 
 
Unless the Products are faulty, we will be entitled to recover any direct costs of having to recover the Products from you and may set such costs off against the amount re-credited to you.
 
5. REFUNDS
 
If you cancel your Contract within the 7 day Period in accordance with clause 3 and return to us all the Product(s) which are the subject of the Contract, we will refund the amount due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, excluding a refund of the delivery charges for sending and receiving the item to and from you respectively.
 
If you return the Product for any other reason, for example you claim that the Product is defective or is not what you ordered; we will examine the returned Product and will notify you of any refund you are entitled to via e-mail within a reasonable period of time. Provided that the Product is defective and you have returned the Product within the 14 day returns period, we will refund the amount paid by you for the Product as soon as possible and, in any case, within 30 days of the day we confirm to you via e-mail that you are entitled to a refund for the Product. Products returned by you because of a valid defect will be refunded in full, including a refund of the delivery charges for sending the item to you.
 
In the event that we do not receive the returned goods, we will ask you to provide the certificate of *posting from the Post Office as proof of postage. We reserve the right to refuse a refund if you are unable to provide the certificate of posting.
 
We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
 
6. EXCHANGES
 
Unfortunately we are not able to process exchanges at this moment in time. Please return your item to us following the process above and we will process a refund for you.
